Lasting Powers of Attorney
Appoint someone you trust to make decisions on your behalf if you lose mental capacity. Protect your future with comprehensive legal authority.
What is a Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal document that allows you to choose someone you trust (your attorney) to make decisions on your behalf if you become unable to do so yourself. This could be due to illness, injury, or loss of mental capacity.
Legal Authority
Give someone legal power to act on your behalf when you cannot
Peace of Mind
Know that someone you trust will make important decisions for you
Future Protection
Plan ahead before you need it - you must have capacity to create an LPA
Two Types of LPA
Each covers different aspects of your life. We recommend having both.
Property & Financial Affairs
This LPA gives your attorney power to manage your money, property, and financial matters.
Your attorney can:
- Manage your bank accounts and savings
- Pay your bills and expenses
- Sell your property or investments
- Manage pensions and benefits
When can it be used? Once registered, this LPA can be used immediately with your permission, or when you lose capacity.
Health & Welfare
This LPA gives your attorney power to make decisions about your health, care, and medical treatment.
Your attorney can:
- Make decisions about medical treatment
- Decide where you should live
- Choose care home arrangements
- Make decisions about daily routine
When can it be used? Only when you lack the mental capacity to make your own health and welfare decisions.
When Should You Create an LPA?
The best time to create an LPA is before you need it.
Important: Create While You Have Capacity
You must have mental capacity to create an LPA. Once you lose capacity, it's too late. Don't wait until you need it - by then, it may be impossible to create one.
Many people think LPAs are only for the elderly, but accidents and illnesses can happen at any age. Creating an LPA now ensures you're protected if the unexpected happens. Without an LPA, your family may need to apply to the Court of Protection, which is time-consuming, expensive, and stressful.
